Summary
This Notice to Occupants of Abandoned Property may be used in Illinois to provide notice to potential occupants of residential real property that the holder of a mortgage on the property is seeking to have the property deemed abandoned in order to expedite foreclosure of the mortgage. This template contains practical guidance and drafting notes. The Illinois Mortgage Foreclosure Act allows foreclosures against vacant residential property to be expedited under certain circumstances. A mortgagee using these expedited procedures must conspicuously post two statutory notices at the property. This template should be used as the first notice, which must be posted 14 days before the hearing on the motion for an expedited proceeding. The notice must be in boldface, in at least 12 point type. The content of the notice must be in substantially the form to the content set forth in 735 ILCS 5/15-1505.8(l). A second notice must be conspicuously posted at the property address at least 14 days before the hearing to confirm the judicial sale of the abandoned residential property. 735 ILCS 5/15-1505.8(l)(2).
