Summary

This template is a notice of videotape deposition for use in Pennsylvania. You should use this template to provide notice to all other parties of a videotape deposition. This template contains practical guidance and drafting notes. This template contains numbered items that comply with the requirements of Pennsylvania law for notice of a videotape deposition. See Pa. R. Civ. P. 4017, which specifically governs videotape depositions. However, there are also other Pennsylvania discovery rules that govern oral examination by "simultaneous audio and visual electronic recording," such as Pa. R. Civ. P. 4007.1, 4007.2, 4007.3, and 4007.4 regarding procedure, leave of court, timing, and supplement responses (respectively); Pa. R. Civ. P. 4003.3 and 4003.4 regarding usage of discovered evidence at trial; Pa. R. Civ. P. 4003.5 and 4003.6 regarding experts and expert testimony as part of discovery, and its use at trial. A party taking an oral deposition may have the testimony recorded by audiovisual means. Pa. R. Civ. P. 4017.1(a). Except as otherwise provided by Pa. R. Civ. P. 4017.1, the rules governing the practice and procedure in depositions and discovery apply to video depositions. Pa. R. Civ. P. 4017.1(a). Any party may also have the video deposition simultaneously recorded by stenographic means. Pa. R. Civ. P. 4017.1(a)(1). Video depositions are generally governed by the same rules governing practice and procedure in oral depositions. Pa. R. Civ. P. 4017.1(a).
