Summary
This notice of termination of periodic tenancy may be used by a residential landlord or tenant in Ohio to notify the other party that it is terminating a periodic tenancy. In Ohio, residential periodic tenancies may be terminated without cause so long as the terminating party provides the statutorily required notice. If the tenancy is week-to-week, the terminating party must provide seven days' notice. See Ohio Rev. Code Ann. § 5321.17(A). If the tenancy is month-to-month, 30 days' notice is required. See Ohio Rev. Code Ann. § 5321.17(B). These notice requirements do not apply to commercial periodic tenancies. If the landlord is terminating a periodic tenancy because a residential tenant breached the rental agreement (e.g., failed to pay rent), the landlord does not have to provide a seven-day or 30-day notice and may immediately start the eviction process by serving a three-day notice. See Ohio Rev. Code Ann. §§ 1923.02(A)(9), 5321.17(D). If the landlord is terminating a periodic tenancy because a residential tenant breached a statutory duty under Section 5321.05, the landlord must provide either a seven-day or 30-day notice, as applicable.
