Summary
This precedent is a notice of objection. It contains practical guidance and drafting notes. In order to administer an estate, a court must first issue a certificate of appointment of estate trustee. A notice of objection informs the person applying for a certificate of appointment of estate trustee that their application is being opposed and gives them the grounds for the objection. Any person appearing to have a financial interest in an estate may file a Notice of Objection to the Issuing of a Certificate of Appointment before an application for probate is filed. A Notice of Objection will expire 3 years after it is filed or it may be withdrawn at an earlier time. When an Application for a Certificate of Appointment is made, notice of the filing of the Notice of Objection will be sent to the applicant, after which point the applicant or the objector may be able to bring a motion for directions.
