Notice of Filing of Notice of Removal
(IL)
Summary
This template is a notice of filing of notice of removal you may use to notify adverse parties and the Illinois circuit court that you have filed a notice of removal in the federal district court. The template includes practical guidance, drafting notes, and alternate clauses. Under 28 U.S.C. § 1446(d), promptly after filing a notice of removal in federal court, you must notify all adverse parties of the filing and send a copy of the notice of removal to the Illinois circuit court clerk in the county where the case is pending. Providing a copy of the notice to the circuit court clerk freezes all activity in the circuit court case. Filing this template with the circuit court satisfies this federal requirement so long as you file the original with the circuit court and serve copies on all adverse parties.
