Notice of Filing of Notice of Removal
(FL)

Summary

This template notice of filing of notice of removal is intended for filing in a Florida state court to notify adverse parties and the state court of the filing of a notice of removal to the United States District Court. This template includes practical guidance and drafting notes. 28 U.S.C. § 1446(d) requires that promptly after filing the notice of removal, you must notify adverse parties of the filing and send a copy of the notice to the clerk of the Florida circuit court in the county where the case is pending. Providing a copy of the notice to the clerk freezes all activity in the state case. Filing this template with the Florida court satisfies the notice and filing requirements of 28 U.S.C. § 1446(d), assuming that you file the original with the circuit court and serve copies on adverse parties.
