Notice of Commencement of Proceedings (ON)
Summary
This precedent is an Information for Court Use Form in a claim for lien. It contains practical guidance and drafting notes. The precedent provides notice of that a proceeding has commenced in a claim for lien. Two copies of the form must be filed with the court at the time of the issuance of the Statement of Claim on which it is indicated as a claim for a construction lien. The Statement of Claim must be issued in the office of the local registrar of the Superior Court of Justice for the area in which the premises is in question, or part of them, are situated (O. Reg. 302/18, s. 1). Rule 76 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194, with respect to the new simplified procedure for trying civil actions, and Rule 77, with respect to the case management of such actions, do not apply to construction lien actions.
