Summary
This template is a notice to class members that a class action has been certified in a California superior court. This template includes practical guidance and drafting notes. This notice is designed to satisfy the requirements of Cal. Rules of Ct., Rule 3.766(d), and assumes that class members will be given the opportunity to exclude themselves (i.e., opt-out) from the action. Generally, the court should issue an order regarding the necessity and manner of notice as soon as practicable following certification. See Cal. Rules of Ct., Rule 3.766(c). The content of a notice of class action pendency requires court approval before it is sent. See Cal. Rules of Ct., Rule 3.766(a), (d). To obtain court approval, you must submit the proposed notice to the court along with a statement setting forth certain specified matters regarding the proposed notice. See Cal.
