Notice of Breach of Contract
(CO)
Summary
This notice of breach of contract template letter can be used by a party to a commercial contract governed by Colorado law to provide notice that the other party is in breach of the terms of their agreement and to trigger the period for the defaulting party to cure the breach. This template includes practical guidance, drafting notes, and alternate and optional clauses. Review the underlying contract for which notice of breach is being provided to ensure the proper manner of notice and that notice is sent to the proper individual or department. Review of the contract is needed for the determination of cure terms, including the period allowed for cure, which can vary based on the type of breach. This template presumes that contract termination will be sought if the breach is not cured. The notice should seek appropriate relief and you should determine if the client needs to take further action if the breach is not cured.
