This practice note provides an overview of multi-jurisdictional real estate financing and identifies key questions and issues that should be raised in a multi-jurisdictional real estate financing transaction. The purpose of this practice note is to provide guidance to an attorney supervising local counsel in various jurisdictions and to make counsel for both the borrower and the lender aware of fundamental issues that arise when entering into a loan secured by properties in various jurisdictions. Local counsel should be retained in each state where the real estate serving as security for repayment of the loan is located.
