Motion for Order of Partition

Summary

This template can be used by a party who, being a co-tenant of real property, requests the court to enter an order of partition of real property pursuant to 231 Pa. Code § 1557 following his or her earlier filing of a complaint requesting partition once the other party has either: (i) failed to file an answer to the underlying complaint; or (ii) admitted to the facts as set forth in the complaint. This template incorporates an Order issued by the court granting the motion and requesting that the parties appear for a preliminary conference pursuant to 231 Pa. Code § 1558. This template is for use in the Commonwealth of Pennsylvania. It includes practical guidance and drafting notes.
