Summary

Pennsylvania mortgage foreclosure practice has been variously characterized as: (a) susceptible to manipulation by enterprising mortgagors (this sentiment not surprisingly coming from counsel for foreclosing plaintiffs); (b) draconian and frustrating (this sentiment not surprisingly coming from counsel for mortgagors on the receiving end of foreclosure actions); and/or (c) riddled with traps for the unwary (this sentiment coming from both plaintiff and defense counsel). As such, mortgage foreclosure in Pennsylvania is a great cacophony, with the one common line of reasoning that both plaintiff and defense counsel can agree on being that those who choose to practice in this area should do so only after becoming thoroughly familiar with what is "standard operating procedure." Mortgage foreclosure practice is not an area to jump into lightly with only a passing knowledge of what is required.
