Memorandum of Lease

Summary
This memorandum of lease template may be used to record the material terms of a lease of real property in Connecticut for a term exceeding one year, in compliance with the requirements of Connecticut General Statutes, Section 47-19. This template includes practical guidance, drafting notes, alternate clauses, and optional clauses. In order to comply with Section 47-19, a memorandum of lease must be in writing; executed by landlord and tenant; attested to by two witnesses; acknowledged before a commissioner of the superior court (an attorney licensed in Connecticut) or a notary public; and recorded in the same manner as a deed for the transfer of land. The memorandum of lease must contain the following information: (1) the names and addresses of the parties to the lease; (2) a reference to the lease, with its date of execution; (3) the term of the lease with the date of commencement and the date of termination of such term; (4) a description of the property contained in the lease; (5) a notation if a right of extension or renewal is exercisable; (6) if there is an option to purchase, a notation of the date by which such option must be exercised; and (7) a reference to a place where the lease is to be on file.
