Master Use License

Summary

This template is a master use license agreement between a motion picture production company or an individual motion picture producer (licensee) and a record company (licensor) regarding the use of a specified portion of a master recording in a motion picture. This template includes practical guidance, drafting notes, and alternate clauses. This template assumes that the record company is licensing the master recording to a major motion picture studio for background use in a scene in a motion picture. Forms of this nature are usually drafted by an attorney in the law department of the record company and submitted to the respective production company's legal representative for comments. Sometimes counsel for the motion picture studio (the licensee) may attempt to redraft the master use license, hoping to gain its acceptance by the record company and secure a more favorable agreement.
