Location Agreement

Summary

This is a long form location agreement in which a property owner grants a producer the right to use the property as a location for filming a television historical mini-series. It is drafted in terms more favorable to the owner. This template includes practical guidance and drafting notes. Usually a short-form location release will be sufficient to protect the parties' respective interests (such releases are generally drafted in terms more favorable to the producer). However, the parties may negotiate a long-form agreement that is more favorable to the owner if the property is of considerable value, such as an estate or public building, and the filming crew will be on location for an extended period of time, as in the instant agreement. Note that if works of art are present in the location that will be filmed—or if certain aspects of the structure constitute artistic works—the producer must also consider whether it is necessary to obtain separate releases from the creators of the works of art (who may be different from the owner of the location).
