Summary

This template is a living will directive for use in Kentucky that enables an individual to memorialize their desires regarding life-sustaining treatment. This template includes practical guidance, drafting notes, and optional clauses. As this template is a standalone living will directive, it does not include language appointing a health care surrogate. Note that while the Kentucky statutory template is a combined directive, which includes language appointing a health care agent, there may be a client-specific reason why the client only wants to use a living will directive. Additionally, health care professionals in Kentucky may only accept a living will directive for a client who no longer has decisional capacity, has a terminal condition, or becomes permanently unconscious. Note that this template contains several sections that will require the declarant to initial their choice. Follow all instructions herein to ensure that the template is filled out completely and properly. This template contains living will directive language setting forth the declarant's wishes concerning life-sustaining and other medical treatment. This template should not be used if the client has executed a Living Will Directive and Health Care Surrogate Designation, which incorporates the client's wishes and the appointment of a health care agent into a single document, because of potential conflict between the terms of the Healthcare Surrogate Designation and the Living Will Directive. Note that this template contains blank lines on which the declarant will need to make selections that reflect their wishes. This template does not address property or financial matters.
