Litigation Hold Resource Kit (Federal)

This resource kit provides an overview of how to preserve relevant documents in light of anticipated or actual litigation in federal court. Topics covered include establishing a document retention and destruction policy in advance of litigation; the duty to preserve evidence, including electronically stored information (ESI), once litigation is commenced or reasonably anticipated (and possible sanctions for spoliation); and issuing a litigation hold to a client’s relevant employees.
