Litigation Hold Notice
(NC)
Summary
This litigation hold notice may be used by counsel representing a corporation (whether as in-house or outside counsel) to instruct employees in a North Carolina state case to suspend document, information and electronic media destruction because the materials may be required in litigation. The template includes practical guidance, drafting notes, and alternate clauses. The purpose of a legal hold notice is to ensure the retention of relevant documents for current or future discovery. You must issue it to all employees who may have relevant documents in their possession, custody, or control as soon as the possibility of litigation is probable. This template is intended as a drafting aid and will need modification according to the circumstances of your case. For an example of a preservation letter demanding that an opposing party preserve information, see Document Preservation Demand Letter (NC).
