Lifting the Stay of Proceedings

Summary

This practice note looks at what a creditor can do to have the bankruptcy stay of proceedings lifted so that it no longer operates to prohibit the creditor from commencing or continuing a legal action against the debtor and identifies those situations in which the court has determined it is appropriate to lift the stay.
