Letter to Opposing Party (Introductory Letter, Separation Agreement) (ON)
Summary
This precedent is a standard introductory letter to the opposing party after a lawyer has been retained to prepare a separation agreement in Ontario. This precedent includes practical guidance, drafting notes and optional clause. A full and comprehensive separation agreement in relation to all issues in dispute is often the document that encompasses the entire agreement between the parties arising out of a breakdown of a relationship. After a lawyer is retained to prepare a separation agreement, they should send a letter to the opposing party, if they are not represented, as soon as possible to start the negotiation process of the separation agreement. The letter should include: (1) that a lawyer has been retained by their client to prepare a separation agreement; (2) financial disclosure requirements by both parties; and (3) the lawyer does not represent the opposing party and they must bring the letter to another counsel.
