Summary
Plaintiffs filed their complaint on March 3, 2004. Pursuant to R. 4:24-1(a), August 26, 2005 was set as the discovery end-date. The school district served interrogatories and supplementary interrogatories on plaintiffs. Plaintiffs never answered the supplementary interrogatories, which sought the correct identities of the four individuals named in the complaint, as well as the factual bases for the claimed discrimination. The school district deposed plaintiffs on February 3, 2005. On June 9, 2005, plaintiffs' counsel wrote the school district asking for the addresses of the individuals named in the complaint to serve them. The school district's counsel responded that plaintiffs had not taken any significant action in the case since the February 2005 deposition and that he was not going to guess at the identity of the individuals nor consent to a discovery extension.
