This template is for use by employers to set forth a clear explanation of the system that the employer of nonimmigrants has utilized to determine the “actual wage” in a Labor Condition Application (LCA) for the specified occupation that such employer has paid or will pay workers with similar experience and qualifications. This template includes practical guidance and drafting notes. The employer must place this memorandum—along with other LCA documents—in the employer’s Public Access File (PAF).
