MICHAEL H. KIRSCH, D.D.S., BRADFORD S. JUNGELS, D.M.D. Individually and on behalf of all others similarly situated v. DELTA DENTAL OF NEW JERSEY *
Dr. Gary Krugman, Appellant, 534 Fed. Appx. 113
Summary
HOLDINGS: [1]-Although a district court failed to explicitly analyze the Gunter factors in assessing a fee award upon settlement of a class action, because it employed the percentage of recovery as the primary method to review the fee application in combination with its analysis of the Girsh factors at the same hearing, there was a sufficient basis for appellate review; [2]-There was no abuse of discretion in approving the fee award because the district court engaged in a percentage of recovery analysis; [3]-The district court also did not abuse its discretion in analyzing the lodestar as a cross-check for the fee award.
