Mahmood Khan, Respondent, v. State University of New York Health Science Center at Brooklyn, Appellant., 271 A.D.2d 656

Summary

An employee sought and was granted a preliminary injunction restraining the employer from discharging the employee from his employment pending the trial of the action. Employer challenged the order and the court reversed. Employee claimed that he would be irreparably harmed without the issuance of the injunction because if he lost his position as a faculty member with the employer, he would have no one to support him. The court held that employee's contentions were wholly speculative and conclusory, and, therefore, were insufficient to satisfy the burden of demonstrating irreparable injury.
