Summary

Before respondent husband married appellant wife, the parties entered into a premarital agreement (agreement). Both parties had substantial assets, although respondent's assets and income were well in excess of appellant's. After about seven years of marriage, respondent filed for divorce. Appellant filed an answer, which denied the validity of the agreement. To avoid their disqualification, respondent's counsel got appellant to file an amended answer admitting the validity of the agreement. Subsequently, appellant sought to amend her answer again to challenge the validity of the agreement. The trial court denied the motion. After trial, the trial court enforced the agreement. Appellant sought review, challenging the denial of her motion to amend, and the failure to determine the validity of the agreement. Respondent then moved for attorney's fees, which the trial awarded.
