Summary

This survey addresses the requirements for judicial foreclosure including minimum default period, notification standards, deficiency judgments, and borrower's right to cure. This survey covers only state laws and regulations due to the lack of federal treatment of the issues in focus. Highlighted issues include prerequisites including requisite notice of sale and/or default periods, judicial confirmation of sale, timing of sale, and limits on deficiency judgments. Statutes and regulations in all 50 U.S. states, the District of Columbia, Guam, Puerto Rico, and the U.S. Virgin Islands are detailed.
