Interrogatories
(Opposer/Petitioner to Applicant/Respondent) (TTAB)

Summary

These are form interrogatories that an opposer/petitioner (plaintiff) may serve on an applicant/respondent (defendant) in a trademark opposition or cancellation proceeding before the Trademark Trial and Appeal Board (TTAB) of the U.S. Patent and Trademark Office (USPTO). This template includes practical guidance, drafting notes, alternate clauses, and optional clauses. These interrogatories assume applicant's/respondent's mark is for goods and that the primary ground for opposition/cancellation is likelihood of confusion. If the opposition/cancellation involves services, different or additional grounds, or if applicant/respondent asserted counterclaims, revise these interrogatories accordingly. For guidance on opposition and cancellation proceedings before the TTAB, see TTAB Litigation: Procedural Considerations. For other TTAB resources, see TTAB Proceedings Resource Kit.
