Internal Challenges under the Indian Gaming Regulatory Act

Summary

This practice note provides guidance on navigating the internal process of quasi-judicial review within the National Indian Gaming Commission (NIGC) when specifically considering an appeal for a negative decision on a management contract, gaming ordinance, or related matter. The process will differ for appeals regarding an NOV decision based on noncompliance with other parts of the Indian Gaming Regulatory Act (IGRA or Act). All Indian gaming operations are required to comply with the IGRA and the regulatory provisions of the NIGC.
