Interim Separation Agreement (ON)
Summary
This precedent is a standard interim separation agreement in Ontario where either settlement is reached only on certain (but not all) issues or where settlement is reached only on a temporary basis. This precedent includes practical guidance and drafting notes. Interim separation agreements are appropriate where the negotiations are potentially protracted, and the parties wish to bring some certainty to their lives pending negotiations. An interim separation agreement can include the following provisions: (1) parenting arrangements; (2); temporary support arrangements; (3) arrangements for the matrimonial home; (4) preservation of property; and (5) without prejudice terms.
