Summary

This survey discusses insurance claims resolutions and unfair practices. It details state statutes, regulations, and requirements for the availability of private rights of action for violations of unfair claims settlement statutes, acknowledgment of an insured's claim, and claim investigation completion periods. The survey covers all 50 U.S. states, Guam, Puerto Rico, the U.S. Virgin Islands, and the District of Columbia. In many states, the statute or judicial interpretation of whether a private cause of action exists is ambiguous or does not exist. State statutes requiring strict adherence to statutorily imposed deadlines or time limits may provide express exceptions for reasonable delays.
