Summary
This precedent is a sample initial opinion letter sent by defence counsel to their client upon receipt and review of a new file. An opinion letter sets out, in as much detail (contained in the file) as possible about the insured and the insurance coverage provided. The precedent includes practical guidance and drafting notes. The letter will provide a summary of the claim, including the incident, the plaintiff(s), the damage and injuries (if any), exposure to liability and recommendations regarding the file and next steps to be taken. The purpose of the letter is to provide a roadmap for a claims adjuster to lay out the scope of the claim, any coverage disputes and strategic advice for resolution.
