Summary

This template may be used in New Jersey for the lease of pre-existing industrial or warehouse space that does not require significant work prior to occupancy by the tenant. This template includes practical guidance, drafting notes, and alternate and optional clauses. This template can be used for light manufacturing, assembly, distribution, and / or warehousing use. The lease is a triple-net lease, and the tenant is responsible for all expenses that are incurred with respect to the leased premises (e.g., maintenance, repairs, utilities, taxes, insurance, garbage removal, assessments, etc.) other than capital improvements. If the building has multiple tenants, this template should be modified to address shared spaces, the allocation of common expenses, and liability for damages to the leased premises. This template is drafted from the perspective of the landlord, but contains tenant-favorable drafting notes, alternate clauses, and optional clauses. It should not be used when significant construction work is required to make the leased premises suitable for the tenant's intended use.
