Summary
This template of an industrial/warehouse lease may be used in Indiana for the lease of pre-existing industrial or warehouse space that does not require significant work by the tenant prior to occupancy. This template includes practical guidance, drafting notes, and optional clauses. This template can be used for leasing space for light manufacturing, assembly, distribution, or warehousing. The lease is a triple-net lease, and the tenant is responsible for all expenses that are incurred as to the leased premises (e.g., maintenance, repairs, utilities, taxes, insurance, garbage removal, assessments, etc.) other than capital improvements. If the building has multiple tenants, this template should be modified to address shared spaces, the allocation of common expenses, and liability for damages to the leased premises. This template is drafted from the perspective of the landlord but contains tenant-favorable drafting notes and optional clauses. It should not be used when significant construction work is required to make the leased premises suitable for the tenant's intended use.
