Summary

Pursuant to discovery requests, the company produced documents previously submitted in to foreign government in support of the company's application for non-imposition or reduction of fines in cartel cases and documents submitted in support of the company's request for leniency in connection with an investigation of the choline chloride industry. The competitors filed the instant motion and argued that the company failed to produce an educated witness as required by Fed. R. Civ. P. 30(b)(6). The court held that the company was obligated to produce one or more Rule 30(b)(6) witnesses who were thoroughly educated about the noticed deposition topics with respect to any and all facts known to the company or its counsel, regardless of whether such facts were memorialized in work product protected documents or resided in the minds of counsel.
