In re: KCC-FUND V, LTD., Debtor, 96 B.R. 237

Summary

Debtor was in the property management business. Immediately before the Chapter 11 bankruptcy filing, a receiver was appointed for three apartment buildings that debtor owned. Debtor filed a motion seeking turnover of the apartments, and one of the secured creditors filed an opposing motion to excuse compliance with the turnover requirement of 11 U.S.C.S. § 543. The court denied the debtor's motion and granted the creditor's motion because the debtor had been uncooperative with the United States Trustee and had maintained the property inadequately.
