ILLINOIS BETA CHAPTER OF SIGMA PHI EPSILON FRATERNITY ALUMNI BOARD, Plaintiff-Appellee, v. ILLINOIS INSTITUTE OF TECHNOLOGY, Defendant-Appellant., 409 Ill. App. 3d 228

Summary

A private institution implemented a new housing policy requiring students who breached their residence hall contracts to move into a fraternity house to fulfill 100% of their obligation to the residence hall. The trial court erred by granting a fraternity's request for a preliminary injunction against the institution's right to enforce the policy, because there was an adequate remedy at law. The gravamen of the fraternity's complaint was breach of contract, and money damages were the appropriate remedy for breach of contract. Because no students, fraternities or sororities had suffered losses because of the new policy, the case was not ripe for judicial intervention.
