This practice note discusses the requirement for ICBC to pay Part 7 benefits within 4 weeks after it receives a proof of claim and thereafter every 4 weeks. It also outlines the circumstances under which ICBC can deny benefits to an insured and the recourse available to an insured if ICBC denies a claim for Part 7 benefits. Moreover, this practice note explains when ICBC will not be required to pay Part 7 benefits to insured persons, including with respect to persons who were resident outside of British Columbia; examines the requirement to deduct ICBC benefits received from damages awards granted as a result of actions for personal injuries; and outlines when ICBC is entitled to terminate benefits for noncompliance with specified requirements.
