Summary

This precedent is a letter from client's counsel to the health records department of a hospital requesting a complete set of hospital notes, including the admission, confinement and discharge notes, x-ray reports, operative notes, ambulance call reports and doctors' and nurses' notes with respect to the client's proceeding. This precedent includes practical guidance and drafting notes. Personal injury actions usually involve a large volume of medical records. All relevant medical records should be requested and disclosed. The general rule of thumb is to request records from 2-5 years prior to the date of loss and ongoing to the time of trial, depending on the circumstances of the case. All relevant medical documentation should be obtained well in advance of examinations for discovery.
