HOLDINGS [1]-For purposes of overtime pay, a high-earning employee was not compensated on a salary basis under 29 C.F.R. § 602(a) (2015) when his paycheck was based solely on a daily rate. Rather, the employee could qualify as paid on salary only under 29 C.F.R. § 604(b) (2015); [2]-An employee's compensation did not meet § 604(b)'s conditions, and thus did not count as a salary, where he was not paid by the week or longer. As a result, he was not exempt from the FLSA; instead, he was eligible under that statute for overtime pay.
