Fredric Haberman, et al., Appellants, and American Express Travel Related Services Company, Inc., et al., Appellant/Intervenors, v. Washington Public Power Supply System, et al., Respondents, and Chemical Bank, Respondent in its capacity as Bond Trustee, 109 Wn.2d 107
Summary
The case involved various bondholders' claims against respondent public power company and others, for injuries resulting from respondent's default on $ 2.25 billion in revenue bonds issued to finance construction of two nuclear power generating plants. The trial court dismissed all bondholders' claims for their failure to state a claim for relief pursuant to Wash. Super. Ct. Civ. R. 12(b)(6). Upon review, the trial court's judgment was reversed on several issues. The trial court's order was reversed as to appellants' and intervenors' claims under the Securities Act of Washington and intervenors' common law fraud and negligent misrepresentation claims; reversed as to denial of appellants' motion to allow the claims of newly added plaintiffs to relate back to the original filing date of the action; and affirmed as to all remaining claims.
