Summary

This due diligence checklist is intended for use in connection with the financing of a leasehold estate, and should be used as a guide in an attorney's due diligence review of a ground lease. This sample checklist includes those provisions a financeable ground lease should (or should not, if applicable) contain. This checklist is not exhaustive of all of the items that an attorney should consider in connection with his or her review of a ground lease. The items to consider will vary from deal to deal depending on a number of factors such as the size and complexity of the transaction, the nature of the mortgaged property, and the location of the mortgaged property.
