Summary

The property owner originally owned the adjoining property owners' parcel and used roadways located on the parcel to access its shopping center property and its apartment complex property, both of which were located on either side of the adjoining property owners' parcel. After the adjoining property owners acquired their parcel, they informed the property owner that it was no longer able to use the roadways to access its shopping center and apartment complex, and the property owner filed an action seeking to enjoin the adjoining property owners from interfering with its claimed easements. The trial court initially denied the property owner's request for injunctive relief but later vacated a portion of its order concerning the easement to the apartment complex.
