Grandparent's Standing in Loco Parentis (ON)
Summary
This practice note discusses how decision-making responsibility and contact issues are determined in situations where grandparents stand in place of a parent for their grandchildren and situations where children are in the care of their grandparent(s) for extended periods of time. In such circumstances, courts are generally reluctant to remove children from the care of their grandparents, and grandparents are more likely to be successful in obtaining or retaining decision-making responsibility of their grandchildren.
