Summary

This general warranty deed template may be used by a seller/grantor in Kentucky to transfer title to commercial real property to a buyer/grantee. This template includes practical guidance and drafting notes. Practitioners in Kentucky customarily utilize general warranty deeds, special warranty deeds, and quitclaim deeds. A general warranty deed contains covenants of title and warranties against any acts in the title chain that may have caused defects in title. A special warranty deed provides the same warranties as the general warranty deed, but it limits the warranty with respect to claims or encumbrances arising by, through, or under the seller. In other words, with a special warranty deed, the seller is making no warranty with respect to title matters arising prior to the seller's period of ownership of the property. A quitclaim deed releases the interest of the grantor in the property but contains no warranties that the seller has any interest in the property or that the property is free from the claims of others.
