Furlough Notice

Summary

This template is a furlough notice that employers can use to notify individual employees that their employment has been furloughed. The template includes practical guidance, drafting notes, and alternate and optional clauses. This template is intended for private employers. This policy is based on federal law. It does not address potential state law distinctions; thus, you should check any relevant state and local laws. A furlough generally refers to a temporary, involuntary, and unpaid leave from work. A furlough may take the form of a leave of absence for an anticipated time period, or it may be a reduction in hours while the employee continues to work for the employer. For a full listing of key content covering departing employees, see Departing Employees Resource Kit. For more information on furloughs generally, see Reduction in Force (RIF) Alternatives (Including Furloughs). For information on topics relating to furloughed employees, such as Worker Adjustment and Retraining Notification Act (WARN) and mini-WARN state laws, continuation of health benefits (Consolidated Omnibus Budget Reconciliation Act (COBRA) and mini-COBRA state laws), and unemployment insurance, see Departing Employees Resource Kit.
