Summary

The former employee was an African-American woman who had been terminated from her employment as a result of violating company policy with regard to her leave to care for her sick father. After her termination, the former employee wrote a letter of resignation and waited three years to bring her lawsuit. She asserted that a change in her job title and duties was discriminatory and that racial slurs were made to her. The court held that the former employee failed to raise a triable issue of material fact as to whether any adverse employment action she alleged she suffered occurred under circumstances giving rise to an inference of discrimination. The changes in the terms and conditions of her employment were found to have been applied to all similarly situated employees and the restructuring that occurred was for the employer to qualify for state funding.
