The Department of Justice (DOJ) and the Securities and Exchange Commission (SEC) jointly enforce the Foreign Corrupt Practices Act (FCPA) against companies and their officers, directors and employees, pursuing criminal and civil penalties, respectively. This checklist is intended to inform counsel of issues their clients should consider to ensure compliance with the FCPA.
