Summary
The Board held that the workers' compensation commission lacked subject matter jurisdiction over the res because no claim was asserted by the employees of their right to workers' compensation benefits. Further, the Board held that a medical provider did not have standing before the commission in the absence of a claim by an injured employee or his dependents for benefits under the Act. Thus there was no basis upon which the commission would inquire as to the medical services provided. The court affirmed. Under the Act the commission had jurisdiction if a written notice of claim was filed by the employee or a workers' compensation commissioner under Conn. Gen. Stat. § 31-294c(a) or one of the statutory jurisdictional alternatives must be satisfied. The court held the medical provider did not have the statutory authority to furnish the notice required of an employee to invoke the jurisdiction of the commission.
