Family and Medical Leave Policy

Summary

This template is a policy that sets forth the rights and obligations of employees taking family and medical leave under the federal Family and Medical Leave Act (FMLA) for use by Nevada employers. This template includes practical guidance, drafting notes, and an alternate clause. All public sector employers, or private sector employers who employ 50 or more people in 20 or more workweeks in a calendar year, must comply with the FMLA, in addition to corresponding local laws. Outside of the federal FMLA, Nevada has no separate laws that require private sector employers to provide family or medical leave. However, if an employer provides paid or unpaid sick leave, the employer must allow an employee to use any accrued sick leave to assist a member of the immediate family of the employee who has an illness, injury, medical appointment, or other authorized medical need to the same extent and under the same conditions that apply to the employee when taking such leave. Nev. Rev. Stat. Ann. § 608.01975; 2021 Nev. AB 190. Such leave does not extend the maximum amount of leave to which an employee is entitled to take pursuant to the Family and Medical Leave Act. 2021 Nev. AB 190; 29 U.S.C. §§ 2601 et seq. Employers must provide paid leave in accordance with Nev. Rev. Stat. Ann. § 608.0197. This template is intended for private employers and may be included in an employee handbook or distributed as a standalone policy. The language complies with Nevada and federal law.
