Summary

This chart provides a summary of recent Federal Trade Commission (FTC) enforcement actions involving Section 5 of the FTC Act in the behavioral or conduct context, rather than in the merger context. Section 5(a) of the FTC Act, 15 U.S.C. § 45(a), prohibits "unfair methods of competition," which include violations of the Sherman Act and also certain standalone violations, including invitations to collude, which are not illegal under the Sherman Act.
